| Abstract | On 4 Jan., 1850, Levin H. Peterson, by Jenny Underhill, his next friend, by William W. Handy, his solicitor, files petition; Levin H. Peterson, free negro boy, an infant, under the age of 21, states that on 4 Dec., 1849, he was bound apprentice to James J. King; said King got indenture by false representations to court; my mother died when I was not 2 years old; Jenny Underhill assumed duties of mother; I was bound apprentice to her on 30 Apr., 1839; asks that indenture to James King be set aside & he be summonded to answer petition. Be it remembered that on 30 Apr., 1839, this court bound Levin H. Peterson, a free boy of color, aged 2 years on 5 May, to Jeny Underhill, to learn trade of labourer. [ Signed by her mark by Jenny Underhill & James Polk, Reg.] [ several appearances regarding this case. Summons issued for James J. King. James J. King, by William S. Waters, his solicitor answers ptetition; Denies that mother of Levin H. Peterson died when he was two, but in Dec., 1848, when he was nearly ten; he was never in custody of Jenny Underhill; indentures of 30 'Apr, 1839 are illegal; Jenny not a person to whom someone can be bound. she is free negro of bad character having no visible means of support; petitioner not been with Jenny since his apprenticeship; has been floating about from place to place; father & mother of petitioner;, on or about Sept., 1847 asked this defendant to take petitioner into his custody; Jenny agreed to this; petitioner wants to stay with this defendant; asks that petiition be dismissed & stay his indenture be established. [Sworn before Tho. G. Dashiell, J.P.] Be it remembered that on 4 Dec., 1849, Levin Petson, a free negro boy aged 10 years on 1 May, 1849, was bound to James J. King to learn trade of farmer. Court rules that indenture of Levin H. Peterson is still in full fource & the facts of their existence was not communicated to this court when it granted new indentures. New indentures to James J. King set aside. James J. King, by William S. Waters, his attorney, files appeal to County Court; granted. |
